Welcome to ShomoySoft! These Terms & Conditions govern your access to and use of ShomoySoft's SaaS services, developer APIs, premium cloud server hosting (PDTHosting), WordPress plugins, themes, and downloadable source code scripts.

1. Acceptance of Terms

By registering for an account, purchasing products, or accessing our services, you agree to be bound by these terms. If you do not agree to all of these terms, do not purchase products or use our services.

2. Account Registration and Use

To access some developer portals, hosting panels, or SaaS tools, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your API keys, client passwords, and credentials confidential.
• Be fully responsible for all actions and transactions processed under your credentials.

3. License Grants & Limitations

For downloadable products (WordPress themes, plugins, and custom source code scripts):

• We grant you a non-exclusive, non-transferable license to use, install, and modify the source code according to the specific license type purchased (Single Site, Developer, or Enterprise).
• You may not resell, redistribute, sub-license, or share the source code scripts or assets in their raw form.

4. Hosting and SaaS Use Restrictions

For cloud servers, hosting accounts (PDTHosting), and SaaS applications:

• You may not use our infrastructure for malicious activities, including spamming, DDoS attacks, hosting phishing content, copyright infringement, or distributing malware.
• We reserve the right to suspend accounts or rate-limit API calls immediately if we detect abuse or activities that degrade service quality for other users.

5. Third-Party Advertisements & Data Sharing

Third-party advertisements are not allowed on our website or within our hosting control panels. If the merchant allows any third-party advertisement, it should be the merchant's responsibility. If the merchant shares any customer information with any third party, it should be the merchant’s responsibility.

6. Limitation of Liability

ShomoySoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or system access, arising out of or in connection with your use of our software, APIs, or hosting configurations.

7. Governing Law

These terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to conflict of law principles.
